We invite you to carefully read these general terms and conditions of use of the website (hereinafter referred to as the “Terms of Use” or simply the “Terms”). Accessing, browsing, and using the Website implies full and unconditional acceptance of these Terms. If you do not agree with any of the Terms, you are advised not to use the Website.

These Terms govern the use of the website http://www.specialcavi.it (hereinafter the “Website”), owned by SPECIALCAVI BALDASSARI S.r.l., with registered office at Località al Cerro no. 76, 55012 Capannori (LU), Italy, registered with the Companies Register of Lucca under number 137741, tax code and VAT number 01387320466 (hereinafter “Specialcavi” or the “Controller”).

The operations contemplated by these Terms of Use are governed by Legislative Decree No. 206/2005 (“Consumer Code”) and Legislative Decree No. 70/2003 (“E-Commerce and Information Society Services Act”), as amended. With regard to privacy protection, the applicable laws are Legislative Decree No. 196/2003 (“Privacy Code”), as amended, and EU Regulation No. 2016/679 (“GDPR”), including subsequent amendments and implementing provisions.

The Website is intended solely for informational and promotional purposes regarding the services, products, and activities of the Controller. It does not constitute a public offer or contractual proposal pursuant to Article 1336 of the Italian Civil Code, nor does it result in the conclusion of online contracts.

3. iNTELLECTUAL PROPERTY

14. Idemnification

The user agrees to indemnify and hold harmless the Controller, its representatives, employees, and collaborators from any claims, damages, liabilities, costs, or expenses, including legal fees, arising from violations of these Terms or unlawful conduct in the use of the Website.

These Terms are drafted in Italian, which constitutes the only official and binding version. Any translation is provided for informational purposes only and shall not prevail in the event of interpretative discrepancies.

21. Availability of digital services

Furthermore, Specialcavi shall be free to use, without any obligation of compensation, any information, ideas, concepts, know-how, or technical knowledge contained in such Contributions for any purpose, including but not limited to the development, production, and marketing of products incorporating such Contributions.

Specialcavi reserves the right to freely and at its sole discretion use the Contributions in any form and manner, including for promotional and commercial purposes, even if unsolicited, without assuming any obligation toward the user who submitted such materials.

Contributions may be visible to other users of the Website and to third-party websites. As such, any Contribution transmitted by the user may be treated as non-confidential and non-proprietary. By creating or making Contributions available, the user represents and warrants that:

  1. The creation, distribution, transmission, public display or performance, access, download, or copying of the Contributions does not and will not infringe upon any proprietary rights, including but not limited to copyright, patent, trademark, trade secret, or moral rights of any third party;

  2. The user is the creator and owner of the Contributions or has the necessary licenses, rights, consents, releases, and permissions to authorize Specialcavi, the Website, and other users to use the Contributions as contemplated by the Website and these Terms and Conditions;

  3. The user has obtained written consent, release, and/or permission from each identifiable individual in the Contributions to use their name or likeness to enable inclusion and use of the Contributions as contemplated by the Website and these Terms and Conditions;

  4. The Contributions are not false, inaccurate, or misleading;

  5. The Contributions do not constitute unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation;

  6. The Contributions are not obscene, vulgar, lewd, violent, harassing, defamatory, or otherwise objectionable (as determined by Specialcavi);

  7. The Contributions do not ridicule, mock, disparage, intimidate, or abuse any individual;

  8. The Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another;

  9. The Contributions do not violate any applicable law, regulation, or rule;

  10. The Contributions do not violate the privacy or publicity rights of any third party;

  11. The Contributions do not contain material that solicits personal information from individuals under the age of 18 or exploits individuals under the age of 18 in a sexual or violent manner;

  12. The Contributions do not violate any laws relating to child pornography or otherwise intended to protect the health or well-being of minors;

  13. The Contributions do not include offensive comments related to race, national origin, gender, sexual preference, or physical disability;

  14. The Contributions do not otherwise violate, or link to material that violates, any provision of these Terms and Conditions or any applicable law or regulation.

Any use of the Website in violation of the foregoing constitutes a breach of these Terms and Conditions and may result in, among other things, termination or suspension of the user's right to use the Website.
